1. Agreement to Terms

By accessing or using the GigPlan application (the "Service"), operated by Own-IT AS ("we", "our", or "us"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, then you may not access the Service.

These Terms apply to all visitors, users, and others who access or use the Service.

2. Use License

Permission is granted to temporarily access and use the Service for personal or commercial purposes. This is the grant of a license, not a transfer of title, and under this license you may not:

• Modify or copy the Service or any part thereof
• Use the Service for any commercial purpose without explicit written permission
• Attempt to reverse engineer, decompile, or disassemble the Service
• Remove any copyright or other proprietary notations from the Service
• Transfer the Service to another person or "mirror" the Service on any other server

This license shall automatically terminate if you violate any of these restrictions and may be terminated by us at any time.

3. User Accounts

When you create an account with us, you must provide information that is accurate, complete, and current at all times. You are responsible for safeguarding the password and for all activities that occur under your account.

You agree not to disclose your password to any third party. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.

You may not use as a username the name of another person or entity or that is not lawfully available for use, a name or trademark that is subject to any rights of another person or entity other than you without appropriate authorization, or a name that is otherwise offensive, vulgar, or obscene.

4. User Content

Our Service allows you to post, link, store, share and otherwise make available certain information, text, graphics, or other material ("Content"). You are responsible for the Content that you post on or through the Service, including its legality, reliability, and appropriateness.

By posting Content on or through the Service, you grant us the right and license to use, modify, publicly perform, publicly display, reproduce, and distribute such Content on and through the Service. You retain any and all of your rights to any Content you submit, post or display on or through the Service.

You represent and warrant that: (i) the Content is yours (you own it) or you have the right to use it and grant us the rights and license as provided in these Terms, and (ii) the posting of your Content on or through the Service does not violate the privacy rights, publicity rights, copyrights, contract rights or any other rights of any person.

5. Prohibited Uses

You may use the Service only for lawful purposes and in accordance with these Terms. You agree not to use the Service:

• In any way that violates any applicable national or international law or regulation
• To transmit, or procure the sending of, any advertising or promotional material without our prior written consent
• To impersonate or attempt to impersonate the company, a company employee, another user, or any other person or entity
• In any way that infringes upon the rights of others, or in any way is illegal, threatening, fraudulent, or harmful
• To engage in any other conduct that restricts or inhibits anyone's use or enjoyment of the Service

6. Data Loss and Backup

IMPORTANT: While we strive to maintain the highest standards of data security and availability, you acknowledge and agree that:

• You are solely responsible for maintaining adequate backups of your data
• We strongly recommend that you regularly export and backup your data independently
• We are not responsible for any loss, corruption, or unavailability of your data
• Technical failures, system errors, or other issues may result in data loss

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, OWN-IT AS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

• Your use or inability to use the Service
• Any loss of data, including but not limited to loss of user content, business data, or any other information stored on or through the Service
• Any unauthorized access to or use of our servers and/or any personal information stored therein
• Any interruption or cessation of transmission to or from the Service
• Any bugs, viruses, trojan horses, or the like, which may be transmitted to or through the Service by any third party
• Any errors or omissions in any content or for any loss or damage incurred as a result of the use of any content posted, emailed, transmitted, or otherwise made available through the Service

OWN-IT AS EXPLICITLY DISCLAIMS ALL RESPONSIBILITY AND LIABILITY FOR ANY DATA LOSS, DATA CORRUPTION, OR DATA UNAVAILABILITY, REGARDLESS OF THE CAUSE, INCLUDING BUT NOT LIMITED TO:

• System failures, hardware failures, or software errors
• Server crashes, database corruption, or backup failures
• Cyber attacks, security breaches, or unauthorized access
• Natural disasters, power outages, or other force majeure events
• Human error, accidental deletion, or administrative mistakes
• Third-party service failures or integrations

You acknowledge that you have been advised to maintain independent backups of all critical data and that you assume full responsibility for any consequences resulting from data loss or unavailability.

8. Disclaimer

The information on this Service is provided on an "as is" basis. To the fullest extent permitted by law, Own-IT AS:

• Excludes all representations, warranties, obligations and liabilities arising out of or in connection with this Service
• Excludes all liability for damages, including (without limitation) indirect or consequential damages, or any damages whatsoever arising from use or loss of use, data, or profits, whether in action of contract, negligence or other tortious action, arising out of or in connection with the use of the Service

We do not warrant that the Service will be available at all times or that it will be error-free, secure, or free from viruses or other harmful components.

9. Service Availability

We reserve the right to withdraw or amend the Service, and any service or material we provide on the Service, in our sole discretion without notice. We will not be liable if, for any reason, all or any part of the Service is unavailable at any time or for any period.

From time to time, we may restrict access to some parts of the Service, or the entire Service, to users, including registered users.

10. Termination

We may terminate or suspend your account and bar access to the Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.

Upon termination, your right to use the Service will immediately cease. If you wish to terminate your account, you may simply discontinue using the Service.

All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity and limitations of liability.

11. Governing Law

These Terms shall be interpreted and governed by the laws of Norway, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect.

12. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days notice prior to any new terms taking effect.

What constitutes a material change will be determined at our sole discretion. By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms.
